外国人在中国工作须具备哪些条件呢?

Qualifications for foreigners to work in China

根据《外国人在中国就业管理规定》第七条,外国人在中国就业须具备下列条件:

According to Article 7 of Regulations on the Management of Employment of Foreigners in China, any foreigner seeking employment in China should meet the following qualifications:

 

1.年满18周岁,身体健康;

Having reached the age of 18 and being healthy;

2.具有从事其工作所必须的专业技能和相应的工作经历;

possessing the professional skills needed for and corresponding work experiences in the work to be taken up;

3.无犯罪记录;

free from criminal records;

4.有确定的聘用单位;

having specific employer units;

5.持有有效护照或能代替护照的其他国际旅行证件。

possessing valid passports or other international travel documents that can replace passports.

▲同时,根据《中华人民共和国出境入境管理法》第四十一条的规定,外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。

In addition, Article 41 of the Exit and Entry Administration Law of the People's Republic of China stipulates that foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations.

什么是“非法就业”呢?

The definition of unlawful employment


根据《中华人民共和国出境入境管理法》第四十三条的规定,外国人有下列行为之一的,属于非法就业:

As regulated by Article 43 of the Exit and Entry Administration Law of the People's Republic of China, any of the following acts of foreigners shall be deemed unlawful employment:


1.未按照规定取得工作许可和工作类居留证件在中国境内工作的;

Work in China without obtaining work permits or work-type residence permits in accordance with relevant regulations;


2.超出工作许可限定范围在中国境内工作的;

Work in China beyond the scope prescribed in the work permits;


3.外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。

Foreign students work in violation of the regulations on the administration of foreign students working to support their study in China and work beyond the prescribed scope of jobs or prescribed time limit.

“非法就业”有什么危害呢?

What is the harm of unlawful employment?


国人非法就业违反我国有关法律规定,冲击和影响我国劳动力市场秩序和就业环境,极易衍生其他违法犯罪活动,给国家安全和社会稳定带来风险隐患。

It violates the related laws and provisions of China with a huge impact on the order of the labor market and employment environment in China and may incur other illegal and criminal activities, bringing risks and potential dangers to national security and social stability.

外国人非法就业、介绍或雇佣非法就业的外国人分别又会受到什么处罚呢?

What are specific punishments for foreigners that work for unlawful employment or serve as introducer or employer of such employment?


根据《中华人民共和国出境入境管理法》第八十条规定:

As stated in Article 80 of the Exit and Entry Administration Law of the People's Republic of China


1.外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。

foreigners who work in China illegally shall be fined not less than RMB 5,000 but not more than RMB 20,000; where circumstances are serious, they shall be detained for not less than five days but not more than fifteen days and shall also be fined not less than RMB 5,000 but not more than RMB 20,000.


2.介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。

Persons who introduce jobs to ineligible foreigners shall be fined RMB 5,000 for each job illegally introduced to one foreigner, with a cap of not more than RMB 50,000 in total; and entities that introduce jobs to ineligible foreigners shall be fined RMB 5,000 for each job illegally introduced to one foreigner, with a cap of RMB 100,000 in total; and the illegal gains, if any, shall be confiscated.


3.非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。

 Individuals or entities that illegally employ foreigners shall be fined RMB 10,000 for each illegally employed foreigner, with a cap of RMB 100,000 in total; and the illegal gains, if any, shall be confiscated.


根据第六十二条规定,外国人非法就业,可以遣送出境。被遣送出境的人员,自被遣送出境之日起一至五年内不准入境。

Also, Article 62 of the document stipulates that foreigners illegally working in China may be repatriated. Repatriated persons shall not be allowed to enter China for one to five years, calculating from the date of repatriation.


为维护我省出入境管理和涉外治安秩序,请广大群众踊跃参与社会治安管理,对非法就业外国人和非法聘用外国人的单位和个人进行举报。公安机关将根据相关规定进行奖励,并严格执行保密制度,对举报人的信息严格保密。

To maintain the well-organized exit-entry administration and foreigner-related public security in Sichuan Province, we encourage the public to actively take part in the public security administration by reporting employers or individuals involved in unlawful employment. The public security organs will reward the informant according to related regulations, and strictly follow the confidentiality required to keep their personal information undisclosed.
